ISO 37001 applies to organizations of any size, sector, or geographic location, in both public and private sectors. It is particularly relevant for organizations operating in jurisdictions with high corruption indices or participating in international supply chains.
ISO 37001 requires the designation of an anti-bribery compliance function (clause 5.3.2) with authority and resources to oversee the ABMS design and implementation. It must be independent from operational areas to avoid conflicts of interest.
ISO 37001 certification does not constitute an automatic exemption from criminal liability. However, it demonstrates that the organization has implemented reasonable and proportionate measures to prevent bribery, which can be a significant mitigating factor before regulators and courts.
